The purchaser, user, and transferee of the DEEP POWDER PASS acknowledges that skiing/snowboarding is an inherently dangerous activity and explicitly agrees to assume any and all risks of injury, property damage, or death associated with his/her participation in the sports of skiing and snowboarding. By using the DEEP POWDER PASS, the purchaser, user, and transferee hereby agrees to release and agree to indemnify Cottonwood Canyons Foundation, its officers, board members, agents and/or employees from any and all claims for injury or damages, arising out of or in connection with the use of the DEEP POWDER PASS.


The Cottonwood Canyons Foundation and the ski areas honoring the DEEP POWDER PASS do not assume responsibility for weather, snow conditions or any other factor that may prevent the pass holder from receiving the full benefit of the pass. The holder of this DEEP POWDER PASS is subject to all rules and regulations in effect at each ski area; the holder is not entitled to any special privileges or exemptions. The holder acknowledges that Utah law provides that “an individual engaged in the sport of skiing may not recover from a ski operator for injuries resulting from the risks that are inherent in the sport of skiing.” Utah Code section 78B-4-401. Your lift ticket may be confiscated by management of any ski area if, in its judgment, the pass holder fails to obey rules and/or directions. Any resort may revoke a DEEP POWDER PASS card holder's use of the pass if at the resort's discretion the holder of this pass should have skiing/snowboarding privileges revoked without refund. Your DEEP POWDER PASS may be canceled, without any refund, at the discretion of the Cottonwood Canyons Foundation, if you abuse your skiing/snowboarding privilege by acts which endanger yourself or others or by willful violation of any DEEP POWDER PASS terms and conditions. Your DEEP POWDER PASS is transferable. All transferees are subject to the same terms and conditions as the original pass holder. The transferor remains responsible for use or misuse of the pass by transferees. DEEP POWDER PASS may not be sold on or off ski area premises. Passes will be confiscated and violators are subject to prosecution for theft of services for DEEP POWDER PASS users reselling their lift tickets on or off the ski area premises. Using the DEEP POWDER PASS for any financial gain (such as a benefit of a vacation rental) is strictly prohibited and violators are subject to prosecution for theft of services. The Cottonwood Canyons Foundation reserves the right to revoke without refund or refuse sale of the DEEP POWDER PASS to anyone who violates any DEEP POWDER PASS or ski area rules or regulations. In the event of loss or theft of your DEEP POWDER PASS, you must notify the Cottonwood Canyons Foundation by calling (801) 703-7574 or e-mail us at [email protected]. Your DEEP POWDER PASS can be replaced upon payment of a $150 reissue fee. Neither the Cottonwood Canyons Foundation or the redeeming ski area, assume responsibility for unauthorized use of any DEEP POWDER PASS until after the theft has been properly reported to the Cottonwood Canyons Foundation at the above location. Parking at any participating ski area (reservation systems or paid parking) is the sole responsibility of the pass holder. This DEEP POWDER PASS does not include any parking or transportation benefits. Pass holder, on his/her own behalf, as well as on behalf of those to whom he transfers the DEEP POWDER PASS, agrees to release from liability, to defend, indemnify, and hold harmless the Cottonwood Canyons Foundation and participating ski areas, their respective employees, agents, officers and associated corporate entities from any and all claims arising out of the use of the DEEP POWDER PASS.
